Standing Order Terms and Conditions

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS INCLUDING THE WESTERN UNION TERMS AND CONDITIONS CAREFULLY BEFORE ARRANGING YOUR STANDING ORDER AND ENSURE YOU RETAIN A COPY OF THESE TERMS AND CONDITIONS FOR FUTURE REFERENCE.

Formation of the contract

1.1 These terms and the Western Union money transfer terms and conditions below, (together, referred to as the "Terms") apply to the Western Union Money Transfer Service available to customers who complete the required registration procedure for using standing orders as a method of payment for sending Western Union Money Transfers (the "Standing Order Service").

1.2 The Standing Order Service is supplied by FEXCO Money Transfer Limited, a company registered in England and Wales with company number 2383761 ("FEXCO MT") acting in its capacity as appointed authorised agent for Western Union Network (Ireland) Limited.

1.3 No contract will exist between you and FEXCO MT for the supply and acquisition of the Standing Order Service until:
- 1.3.1 You have registered with FEXCO MT
- 1.3.2 You have sent and FEXCO MT has received each individual standing order payment from you in accordance with the Terms. On each occasion that FEXCO MT receives your standing order payments in accordance with the Terms, there will be formed a separate binding legal contract between us.
- 1.3.3 FEXCO MT will accept your standing order payment by sending the funds you wish to transfer using the Western Union Money Transfer Service (your "Money Transfer") to a recipient as specified by you on the authorisation below.

1.4 The registration for the Standing Order Service is subject to your right of cancellation referred to in paragraph 7.

1.5 FEXCO MT may change the Terms in relation to the future provision of the Standing Order Service with at least one month's prior written notice to you.
2 Registration for the Standing Order Service

2.1 In order to have the benefit and use of the Standing Order Service, you will need to register with FEXCO MT by providing FEXCO MT with the following documentation by post to the address shown at the bottom of this page
- 2.1.1 A signed copy of the Terms
- 2.1.2 A completed copy of the attached application form detailing the designated receiver, the date funds leave your account and amount of the Money Transfer together with the applicable transfer fee
- 2.1.3 Documentary evidence confirming that your bank or building society account is located in the United Kingdom
- 2.1.4 Certified copies of one form of acceptable, current and valid identification to verify your name in any of the forms listed
A certified copy of your current signed passport or
A certified copy of your current UK Photo-Card Driving Licence - old style non-photographic or provisional driving licences will not be accepted.
- 2.1.5 Certified copies of one form of acceptable, current and valid identification to verify your current address in any of the forms listed below :
A certified copy of your recent utility bill or a certificate from a supplier of utilities confirming the arrangement to pay for the services on pre-payment terms - mobile telephone bills will not be accepted or
A certified copy of your local authority tax bill valid for the current year or
A certified copy of your bank, building society or credit union statement or passbook containing your current address or
A certified copy of your most recent original mortgage statement from a recognised lender or
A certified copy of your local council rent card or tenancy agreement.Each identification document you send must be certified as a true copy of the original by either a solicitor practising in the UK, a bank official, an authorised financial intermediary, a MCCB regulated mortgage broker, an accountant, a teacher or a doctor and the person undertaking the certification must be capable of being contacted by FEXCO MT if necessary.

2.2 FEXCO MT reserves the right to reject any, or request further information in respect of the documents required for registration.

3 Transfer fees for the Standing Order Service

3.1 The standing order transfer fee only applies to standing order customers and differs from the transfer fees for money transfers sent using a credit or debit card or through an agent location.

3.2 The fees for the use of the Standing Order Service by you will be as shown in FEXCO MT's current list of transfer fees attached to the Terms and may be varied by FEXCO MT from time to time and notified to you with at least one month's prior written notice.

3.3 Every effort is made to ensure that prices shown in FEXCO MT's current list of transfer fees are accurate at the time you send your standing order payment. If an error is found, FEXCO MT will inform you as soon as possible.

4 Foreign Exchange Rate

4.1 In addition to the transfer fees applicable to each transaction, Western Union will apply a currency exchange rate set by Western Union. Any difference between the currency exchange rate offered to customers and the currency exchange rate received by Western Union will be kept by Western Union (and, in some instances, its agents) in addition to the transfer fee. Additional information about exchange rates for specific destination countries can be obtained by calling FEXCO MT at 0800 833 833.

4.2 The foreign exchange rate applied to your Money Transfer will be applied at your option either:
- 4.2.1 On the date on which the Money Transfer is transmitted by FEXCO MT (Fixed); or
- 4.2.2 On the date on which the Money Transfer is collected by the named recipient (variable).

4.3 You can specify the date on which the foreign exchange rate is to apply on the attached application form.

5 The Standing Order Service

5.1 The Standing Order Service will allow you to send your Money Transfer directly to your chosen recipient on a regular basis determined by the date specified by your standing order after you have:
- 5.1.1 Registered with FEXCO MT; and
- 5.1.2 Credited FEXCO MT by standing order with your Money Transfer in full and in cleared funds, together with the applicable transfer fees. Please note your funds can take three working days to reach FEXCO MT's account from the day monies leave your account.

5.2 You can specify on the authorisation below:
- 5.2.1 The date payment is to leave your account and the frequency with which the Money Transfer is to be sent;
- 5.2.2 The name of the designated receiver; and
- 5.2.3 Whether the exchange rate to be applied to the Money Transfer is either the rate on the date the Money Transfer is transmitted by FEXCO MT (fixed) or the rate on the date on which the Money Transfer is collected by the named recipient (varied).

5.3 The Money Transfer will be made on the same day that the standing order payment is received from you providing that:
- 5.3.1 The standing order payment received by FEXCO MT in cleared funds comprises the Money Transfer and the applicable transfer fee referred to in paragraph 3; and
- 5.3.2 The standing order payment is received by FEXCO MT on any working day and during normal banking hours. Where FEXCO MT receives a standing order payment on a non-working day, or outside normal banking hours, then FEXCO MT may transmit the Money Transfer on the next working day. A working day is any day other than weekends and bank or other public holidays recognised in the UK and normal banking hours are between 9.00 to 3.30pm.

5.4 Every effort will be made to send the Money Transfer as soon as possible after your standing order payment has been accepted. However, FEXCO MT will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in providing the Standing Order Service.

5.5 If on receipt of your standing order payment the monies received by FEXCO MT is different than an amount comprising the Money Transfer and the applicable transfer fee, FEXCO MT will inform you as soon as possible and:
- 5.5.1 If the amount received is more than an amount comprising the Money Transfer and the applicable transfer fee FEXCO MT will deduct the applicable charge and transmit the Money Transfer and subsequently re-credit you with the excess; or
- 5.5.2 If the amount received is less than an amount comprising the Money Transfer and the applicable transfer fee FEXCO MT will not transmit the Money Transfer and if so agreed, FEXCO MT will either:
- 5.5.2.1 Await receipt of the balance due to meet the amount expected and transmit the Money Transfer at a future agreed date; or
- 5.5.2.2 Re-credit you with the amount received.

5.6 FEXCO MT shall send confirmation to you once a Money Transfer has been transmitted.

5.7 FEXCO MT shall not be liable to fulfil its obligations if you cancel, or if your bank or building society cancels the standing order payment and in this event the provisions of paragraph 7.3 shall apply.

6 Payment

The transfer fees for the Standing Order Service will be deducted by FEXCO MT at the time it receives your standing order payment and prior to making the Money Transfer.

7 Your right of cancellation

7.1 You have the right to cancel your registration with FEXCO MT at any time.

7.2 To exercise your right of cancellation, you must advise your bank or building society and give written notice to FEXCO MT by post or fax, at the address or fax number shown on the bottom of this page, providing details of:
- 7.2.1 The date from which the cancellation is due to take place; and
- 7.2.2 The date on which the next standing order payment is due to be paid and if the date from which the cancellation is due to take place is the same date as the date on which the next standing order payment is due to be paid then the provisions in paragraph 7.3 will apply.

7.3 If you exercise your right of cancellation on the date on which a standing order payment has been received by FEXCO MT, FEXCO MT will either:
- 7.3.1 Re-credit your account with the payment received if the Money Transfer has not been transmitted;
- 7.3.2 Re-credit your account with an amount equal to the Money Transfer less the applicable transfer fee if the Money Transfer has been transmitted but not collected by the named recipient; or
- 7.3.3 Advise you in writing if the Money Transfer has been transmitted and collected by the named recipient and in this instance, FEXCO MT will have no further obligation or liability to you.

8 Data protection

8.1 FEXCO MT will take all reasonable precautions to keep the details of your registration for the Standing Order Service secure, but unless FEXCO MT is negligent, FEXCO MT will not be liable for unauthorised access to information supplied by you.

8.2 FEXCO MT will only use the information you provide about yourself for the purpose of providing the Standing Order Service, unless you agree otherwise. FEXCO MT would like to notify you of further information on the services provided by Western Union from time to time, and if you would like to be notified of these, please tick the relevant boxes on the application form.You can correct any information about you, or ask for information about you to be deleted, by giving written notice to FEXCO MT at the address, fax number or email address shown below.

9 Applicable law

These Terms for the supply of the Standing Order Service will be subject to English law, and the English courts will.
